Background
Magnox Ltd ("Magnox") is a wholly-owned subsidiary of the Nuclear Decommissioning Authority.
Magnox is responsible for the safe and secure operation and clean-up of 12 nuclear sites around the UK on behalf of the Nuclear Decommissioning Authority.
Description
Magnox is intending to award a contract for up to 10 years to meet the Magnox Waste Programme needs covering supply of further DCICs, associated services and technical consultancy as summarised in the scope below. Gesellschaft für Nuklear-Service mbH ("GNS") are the sole suppliers of the DCICs used by the Magnox Waste Programme; additionally GNS own all Intellectual Property (IP) for the DCIC containers.

Total Quantity or Scope
To cover Magnox's waste programme, up to 30 additional MOSAIK® s containers is assumed for forecasting purposes to complete the packaging of operational ILW. This is in addition to the 114 MOSAIK® s on order with GNS planned for delivery to Magnox Ltd between 2021 and 2024.
Storage and transportation services will be required to agreed timescales to meet the requirements for Magnox waste processing projects at various sites.
Provide rental of transport equipment and associated training for loading and unloading of DCICs.
Provision of parts and spares to ensure that the Magnox fleet of DCICs are adequately covered as specified by the maintenance schedules. Typically items cover complete sets of protective lid screws, closure lid screws, closure lid O-ring seals, main O-ring seals, lubricants and container identification plates. Additionally, there is a requirement for the supply of paints for undertaking DCIC repairs using paint systems as specified by GNS.
The technical consultancy associated with the use of DCICs remains an important element for ongoing Magnox Waste Programme business. GNS is the design authority for DCICs they supply and there is an ongoing requirement for maintaining this interface.

Explanation:
Magnox Limited is intending to award the contract to GNS using the negotiated procedure without prior publication, pursuant to Regulation 32(2)(b)(ii) of the Public Contracts Regulations 2015.
Magnox Ltd considers that there are no other suppliers in the market who are able to offer approved DCICs and associated equipment as the IP for the DCIC designs, maintenance, inspection and operating specifications reside with GNS. No reasonable alternative or substitute exists and the absence of competition is not the result of an artificial narrowing down of the parameters of the procurement.
Use of DCICs underpins Magnox waste retrieval projects and this award covers the remaining 'legacy' requirement. Magnox Ltd is therefore proposing to award a 10 year agreement to GNS, which will allow enough time to complete the waste retrieval programmes using DCICs.
The values quoted within this VEAT notice are estimates, with the majority of the cost attributed to the additional 30 DCICs.
