CEW will provide advice and reports on current issues affecting the construction sector to Welsh Ministers and Officials, principally, but not exclusively, in the following areas: -
a. Current market intelligence impacting on the sector as affecting WG to deliver PfG and Cooperation Agreement commitments and priorities, sustainability and economic growth along with apprenticeships skills, training and employment opportunities.
b. Advice on procurement, price fluctuation issues, pipeline and net zero carbon and supply chain issues affecting the sector generally.
c. Advice on innovation, collaborative behaviours, and modern methods of construction and standardisation of construction processes which support the circular and foundation economy across Wales.
d. Provide market intelligence, research, and comment on areas of specific WG interest.
Provide the Welsh Government with an annual report for the construction sector, highlighting the impact of public sector investment across Wales along with identified regional and national opportunities.

Explanation:
Extensive market research has been undertaken to ascertain whether there exists an organisation similar to Constructing Excellence Wales (CEW) able to provide unbiased, impartial and credible advice across the entire spectrum of construction activity, and none was identified.
CEW is a not-for-profit organisation widely recognised by the sector as the independent and impartial voice for construction in Wales. It has over 20 years of experience and commitment to supporting improvements, collaboration, and best practice in the delivery of Welsh built assets. They are the only independent professional construction sector advisory body able to provide advice across the entire range of issues in Wales, required to support Ministers.
CEW is well established within the sector within Wales and represents a wide range of construction stakeholders; is an advisor to Welsh Government, Welsh Local Government Association (WLGA), Consortium of Local Authorities in Wales (CLAW), Local Authorities and other public sector bodies. CEW has the ability to engage with, and impartially represent, the full spectrum of supply chain members utilising a trusted relationship which has developed over 20 years.
CEW has the capability to undertake pan-Wales sectoral analysis and reporting, in respect of the impact and value added through our capital investment programmes.
The work they will deliver will provide Ministers with a greater degree of ‘independence than if delivered directly by the Welsh Government and would assist in understanding progress towards the delivery of the Welsh Government’s priorities set out within the Wales Infrastructure Investment Strategy (WIIS) along with dynamic reviews and future iterations of the WIIS.
It is the opinion of Welsh Government that this contract therefore aligns with Regulation 32 (2) (b) (ii) of the Public Contracts Regulations in that “competition is absent for technical reasons”.
