Security Services to NHSGGC Community Sites covers approx. 100 sites and provides various security services to; Partnerships, East Dunbartonshire HSCP, East Renfrewshire HSCP, Inverclyde HSCP, Glasgow HSCP, Renfrew HSCP and West Dunbartonshire HSCP.

The security required is:

1. Alarm Activation (out-of-hours service): in the event of alarm activation (fire or intruder) the supplier is required to attend sites within one hour of notification and identify the activation cause. If necessary, they escalate to NHSGGC nominated employees, the Board’s contractors and/or the Fire Service.

2. Open and Close Premises (planned or ad-hoc): The supplier opens and/or closes Sites as outlined within each Sites standard operating procedure.

3. Manned Security Presence (planned or ad-hoc): The supplier is a manned presence at Sites as outlined within each Sites standard operating procedure.

Section four. Procedure

four.1) Description

four.1.1) Type of procedure

Award of a contract without prior publication of a call for competition in the cases listed below

  • The procurement falls outside the scope of application of the regulations

Explanation:

NHS Greater Glasgow & Clyde (NHSGGC) and their current supplier for Security Services to Community Sites, have mutually agreed to an early contract termination.

It is of high operational importance that the community sites have service continuity as without a security service in place, it leaves the site, staff, patients and visitors vulnerable. Accordingly, NHSGGC do not have the required time to conduct a local tender, further competition or direct award from any Framework(s) and must act urgently due to circumstances beyond its control.

A tender for this service must follow NHSGGC's Procurement Department Serious Organised Crime Mitigation Protocol, which requires a restricted two-stage process and carrying out of necessary due diligence. Upon award, an implementation period will be required. TUPE also applies to this contract.

Given the time constraints and duly substantiated state of urgency, NHSGGC require a supplier who has a knowledge of this contract and can take over the running of security with a seamless transition and have therefore negotiated directly with the previous contractor prior to the incumbent.

In order to award this contract compliantly, NHSGGC will follow Regulation 33 of the Public Contracts (Scotland) Regulations: (1) (c) and (3)

(1) (c) where (but only if it is strictly necessary) for reasons of extreme urgency brought about by events unforeseeable by the contracting authority, the time limits for open procedure, restricted procedure or competitive procedure with negotiation cannot be complied with.

(3) For the purposes of paragraph (1)(c), the circumstances invoked to justify extreme urgency must not, in any event, be attributable to the contracting authority.

NHSGGC intend to award this contract for 24 months. During this period, NHSGGC will publish a contract notice to invite competent suppliers to submit tenders for a longer term contract under a competitive process. It is anticipated that this will be a restricted (two stage) tender process, following the Procurement’s Serious Organised Crime Mitigation Protocol. The tender process will start Q3 2024 and take approx. ten months to complete. The awarded supplier will be given an implementation period of approx. six months.
