Leicester City Council (‘the ‘Authority’) invites Tenders for the provision Free Emergency Hormonal Contraception (EHC) in community pharmacies to young women under 25 years of age. The Authority proposes to award Framework Agreements to successful Tenderers for the provision EHC.

The Service has been divided into Lots and the Authority anticipates awarding the Framework Agreements to up to 12 pharmacies located in the following Leicester city Primary Care Network (PCN) (Lots) for up to the maximum number of pharmacies quoted per Primary Care Network (Lots) below:

Aegis PCN up to a maximum of 2 community pharmacies

City Care Alliance PCN up to a maximum of 1 community pharmacy

Leicester Central PCN up to a maximum of 4 community pharmacies

Leicester City & University PCN up to a maximum of 2 community pharmacies

Millennium PCN up to a maximum of 3 community pharmacies

Tenderers are invited to bid for all or any of the Leicester city Primary Care Network (PCN) (Lots) Name mentioned above. The Authority reserves the right to award the Lots and Framework Agreement to a single Tenderer or combination of Tenderers.

Tenderers can find out the location of their pharmacy as to in which Leicester city Primary Care Network (PCN) (Lots) Name mentioned above it is located by emailing the Leicester Local Pharmaceutical Committee on email address chiefofficer@leics-lpc.co.uk If the pharmacy from which the EHC service is to be provided is not located in one of the PCN Name mentioned above then your tender will be rejected.

two.2.4) Description of the procurement

An Online Microsoft Teams Tenderers Information Session is being held on 14 February 2023 commencing at 10:45 am. Further details regarding how to register for this session is contained within the Invitation to Tender documentation.

Throughout the duration of the Framework, the Authority may at its discretion review the Framework and may open the Framework at its own discretion when a service need arises. A service need includes (but is not limited to):

a lack of capacity from current providers and therefore there is a need to supplement the framework list of providers beyond the numbers initially appointed to the contract;

an increase in the volume of service users requiring the services under the Framework; and

to replace (if required) providers who have been removed, suspended from the framework or did not agree to provide the services.

Opening the Framework will allow the opportunity for any potential new providers who are not currently appointed to the Framework to apply to the Authority, when the new tender opportunity is advertised, to be so appointed for the remainder of the term of the contract.

It is the Authority’s preliminary view that TUPE is unlikely apply in respect of this Contract.

The Authority is conducting this procurement under the Light Touch Regime for Social and Other Specific Services, as set out in the Public Contract Regulations 2015 (PCR), at Section 7 (Regulations 74 to 77) and Schedule 3. The procurement process will not be conducted under the Public Contract Regulations 2015; however, it will be similar to that of an Open procedure. The Process will, unlike an Open Procedure, include the flexibility, as allowed under the Light Touch Regime with various evaluation stages as detailed in this Invitation to Tender documentation.
