two.2.4) Description of the procurement
The land based Air Defence Radar Fleet provides long-range surveillance of UK airspace, through detection of cooperating and non-cooperating targets and reporting of that data to provide situational awareness and enable decision making such as Quick Reaction Alert (QRA).
Contractor Logistics Support (CLS) is delivered from the Original Equipment Manufacturer (OEM) and current CLS provider, Lockheed-Martin Overseas Corporation (LMOC). The existing contract is due to expire on 31 July 22. 1st to 2nd line support is currently provided by the Royal Air Force (RAF) Trade Group 4 (TG4). Due to the ever-increasing demands across Defence, TG4 is recognised as an opportunity to reduce legacy regular demand on the RAF to enable reinvestment into other growth areas and therefore the requirement arises to provide CLS support for all lines of maintenance. The requirement is for a 5-year contract at a value of between £32000000 and £52000000 to provide all levels of maintenance to certain land-based Air Defence surveillance radars to include remote site manager duties.

Explanation:
As the OEM, LMOC own the technical data required for any Contractor to provide any level of maintenance and support to the LMOC manufactured radar fleet. LMOC and their preferred sub-contractor Serco are the only suppliers with the required expertise, specific know how and data to provide in depth support that ensure the specified performance for the radar fleet are maintained and of providing the safety case to ensure compatibility and interoperability of the CLS services in general, to the reasonable satisfaction of the Authority. LMOC have granted Serco with the necessary permissions to allow them access to the technical data to perform the requirement.
The Defence Equipment & Security Air Defence Electronic Warfare Systems team, part of the UK Ministry of Defence (MOD), intends to award a five-year contract to Serco for Contractor Logistic Support (CLS) to MOD’s Air Defence surveillance radar capability. In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (in accordance with the relevant legislation) is lawful in accordance with regulation 16(1)(b)(ii) of the DSPCR 2011 for technical reasons. The technical data is controlled by the International Traffic in Arms Regulations (ITAR) and the Authority does not have the rights to release the relevant technical data for the purposes of competitive tendering nor does it have access to the relevant software codes and/or compiler information necessary for another contractor to perform the contract. LMOC is unwilling to allow any Contractor, other than SERCO, rights to the export controlled technical data.
