The Omicron outbreak and its high transmissibility has however led to an urgent and unforeseeable surge in demand for LFTs. Due to this urgency, UKHSA is unable to comply with the time periods required for a further competitive tender (whether under the DPS or otherwise), as any delay will risk the current stock of competitively-procured LFTs being exhausted thereby introducing a significant risk to public health.
UKHSA has therefore used the negotiated procedure without prior publication under Regulation 32(2)(c) of the Public Contracts Regulations 2015 to award a contract to Innova Medical Group Inc on 31 December 2021 for £215,000,000.

Explanation:

Mass testing using lateral flow testing kits (LFTs) for the detection of Covid-19 viral antigens has become a key part of protecting the economy and saving lives during the Covid-19 pandemic. UKHSA has ensured the supply of LFTs by implementing a Dynamic Purchasing System (as advertised in a contract notice on the Find a Tender Service with reference C22033 on 5 March 2021) and procuring LFTs competitively through that DPS. A further competitive tender through the DPS is currently in progress.
