delivered in accordance with the current contract and specification but may be subject to modification to accommodate any changes in legislation or need or in order to enable the transition to an alliance approach. Drug and alcohol services are specialist treatment services that work with one of the most complex and risky groups in our community. They provide medical and psycho social interventions in accordance with national clinical standards and legal frameworks for those who are seeking support in addressing their substance

misuse issues. Because of the significant risks these individuals may pose to themselves and others, the services need to provide a significant amount of complex and specialist support to enable the individuals to make progress in recovery.

Homelessness services/hostel provision, to be provided by Langley House Trust from 05 May 2022 to 31 January 2023, with an option to extend to 30 April 2023. Services will be

delivered in accordance with the current contract and specification but may be subject to modification to accommodate any changes in legislation or need or in order to enable the transition to an alliance approach. Leonard Stocks provided by Langley House Trust (Shekinah) deliver a support and housing management service to 24 people in the Leonard Stocks building. The client base are adults who are homeless and have a support need and local connection.

This service seeks to engage individuals in breaking their cycle of homelessness and exclusion through the provision of person centred, recovery focused support. The ultimate aim is for an individual to move to, and maintain their own tenancy, engaging in community activities, and employment, training or education.

Services for people experiencing domestic abuse, provided by Sanctuary Supported Living from 05 May 2022 to 31 January 2023, with an option to extend to 30 April 2023. Services will be

delivered in accordance with the current contract and specification but may be subject to modification to accommodate any changes in legislation (with particular reference to any changes required under the Domestic Abuse Act) or need or in order to enable the transition to an alliance approach. Torbay Domestic Abuse Service delivers a range of services to people experiencing domestic violence and abuse aged 16 years and over. This includes 12 units of supported accommodation dispersed throughout Torbay, Independent Domestic Violence Advocacy, outreach support, and adults, children’s and voluntary community perpetrator programmes. Due to the nature of the client group this service provides specialist support around risk identification and safety planning, as well as more general support to enable individuals and their children to break the pattern of abuse.

Section four. Procedure

four.1) Description

four.1.1) Type of procedure

Negotiated without a prior call for competition

  • The works, supplies or services can be provided only by a particular economic operator for the following reason:

  • Extreme urgency brought about by events unforeseeable for the contracting authority

Explanation:

Torbay Council embarked on an experimental alliance commissioning model for complex adult services, covering drug & alcohol treatment, domestic abuse & sexual violence and supported housing. This is an untested approach requiring a comprehensive level of rigour. Initially new service contracts were planned to October 2020 and short-term contracts were put in place with existing providers, following publication of VEAT notice 2019/S 053-123016. There was a delay when the new Council administration necessitated a further period of consultation with elected members in order to agree budgets. The sustained impact of COVID-19 on Council staff and potential bidders at the frontline in responding to the emergency affected the resource available and prevented us from issuing the tender in May 2020 as planned. It was essential current service providers and others on the front-line were supported to continue delivering services to our most vulnerable and the commencement of the tender process was deferred until November 2020. Following publication of VEAT notice 2020/S 078-185574 contracts were directly awarded to the existing providers to continue services and provide system stability, with contracts in place until 04 May 2022. The tender was issued as planned on 04 November 2020, due to the ongoing uncertainties around recovery pandemic an extended submission period, with a deadline of 30 April 2021, is in place to afford providers maximum opportunity to bid.

On 25 January 2021 we received requests from 2 existing providers to extend the submission deadline. The uncertainty around the impact of COVID-19 on services, the current lockdown duration and the recovery process means they are not in a position to submit bids by 31 April 2021. It would be unfair to deny them the opportunity to bid and this situation is likely to apply to other bidders. Due to the importance of this project we want to enable the submission of a good level of high quality bids. We recognise when the current lockdown ends there will be a period of recovery activity required before bidders are able to fully focus the necessary resource on submissions. We intend to extend the submission deadline by 9 months, to 31 January 2022. This will delay the operationalisation of services and delivery will need to continue beyond current contract end dates. This notice sets out our intention to make a direct award of contracts to our incumbents for the period 05 May 2022-30 January 2023, with an option to extend to 30 April 2023. To give bidders the maximum notice possible we intend to confirm the award of contracts and extension to the tender submission deadline during week commencing 22 February 2021.

In accordance with paragraph 5 of Article 32 of Directive 2014/24/EU the new contracts will be issued under the same terms as the original contracts, awarded in accordance with Article 26 of Directive 2014/24/ EU or Article 12 of Directive 2014/24/EU. Although it is recognised requirements may be subject to modification to accommodate changes in legislation (e.g. changes required under the Domestic Abuse Act), need or to enable transition to an alliance approach. We are awarding the contract without prior publication under paragraphs 2(b)(ii), 2(c) and 5 of Article 32 of Directive2014/24/EU. We have a duty to provide these services and cannot be without them for any period of time. Whilst current arrangements do not expire until May 2022, due to the COVID-19 pandemic we are not in a position to tender for short term contracts and only our existing providers are able to maintain continuity of these essential services without the need for a tender process. Given the nature and complexity of the service requirements it is the Council’s view that the unforeseen events due to the COVID-19 pandemic justify this action to ensure ongoing provision beyond May 2022.
