Explanation:
The email of 08/11/23, received from ECRI, stated that "ECRI is the sole sales and support provider for AIMS outside of America. This has been a 16 year partnership with the software owners and developers, Phoenix Data Systems who are located within the USA. Due to our not-for-profit status and very strict conflict of interest rules that ECRI are forced to abide by due to the nature of the work we carry out, we are unable to use distributors or resellers for any of our products and services, including AIMS", Given the content of the email, Belfast Health & Social Care Trust is confident that ECRI Institute is sole-provider for provision of the service covered by this notice. Consequently, BHSCT proposes use of Regulation 32 (Use of the Negotiated Procedure without Prior Publication)

"ECRI is the sole sales and support provider for AIMS outside of America. This has been a 16 year partnership with the software owners and developers, Phoenix Data Systems who are located within the USA.

Reg 32 (2)(b)(iii) is applicable as the required licences and support can only be provided by ECRI as competition is absent as a consequence of the protection of exclusive rights.
This contract with ECRI-AIMS will be for a maximum 3 year period (01/01/24 to 31/12/26).
The maximum contract value of £105,000 has been calculated based on firm prices from ECRI-AIMS, with an allowance for potential growth over the contract period.
