The scope of this contract is:
1.1 Provision of equipment – The contractor is required to provide the necessary machinery for Paint Stripping, Degreasing and Phosphating of guns/gun parts, as part of the Metal Laundry capability at DM Gosport (GOS).
1.2 Servicing and maintenance of machines – The contractor is required to conduct routine servicing and maintenance to the machinery supplied, and to respond and resolve any breakdowns of the machinery.
1.3 Chemical Supply, testing and disposal – The contractor is required to supply the necessary chemicals to allow for the paint stripping, degreasing and phosphating of gun/gun parts. The contractor is also responsible for regular testing of the chemicals being used in these processes and machines, and disposal of chemicals as required.
It is proposed to place Single Source Contract with Metal Wash Ltd using the negotiated procedure without prior publication of a contract notice which is allowable under DSPCR 2011Section 16(a)(ii) when, for technical reasons the contract may be awarded only to a particular economic operator.

Explanation:
Defence Munitions (DM), part of the UK Ministry of Defence, intends to place a new single source contract (DM/00184) with Metal Wash Ltd, for a period of 5 years to provide equipment hire and chemical supply to support the end-to-end process for the Metal Laundry capability at DM Gosport.
In accordance with regulation 4 of the Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate.
It is considered that this contract can be placed with Metal Wash Ltd using the negotiated procedure without prior publication of a contract notice under Regulation 16(a)(ii) of the Defence and Security Public Contract Regulation 2011 for technical reasons. Plant hire and maintenance and Chemical supply testing and disposal can only be placed with Metal Wash Ltd for the following reasons:
1. Metal Wash Ltd are the only known supplier to be able to provide Plant Hire of the Paint Stripping, Degreasing and Manganese Phosphating machines as an end-to-end capability within the Metal Laundry. Metal Wash Ltd -is the only supplier who has the technical know-how to ensure a standardised technical approach across the entire process, ensuring that each machine is integrated and compatible with one another and the DM estate as well as the technical knowledge to ensure the safe operation of each piece of equipment within the capability.
2. Specific processes, machinery and chemicals are required as part of the Metal Laundry capability as depicted in the Technical Documents (Ref: MEPP 001, ASEP 022-A-209-013). Metal Wash Ltd are the only known supplier able to provide a Manganese Phosphating machine for Plant Hire, and the only supplier to have the fit for scale machinery required to fit the specifications of all current weapon types.
3. Metal Wash Ltd are the only known company able to supply both the machines and the specific chemicals required. The use of Grade 1 Manganese Phosphate is prescribed within Technical Document (Ref: MEPP 001, ASEP 022-A-209-013) and no other chemicals are acceptable for use in these processes. Metal Wash Ltd is the only supplier who has the technical expertise to provide assurance to the Authority that the Chemicals supplied are Safety complaint, are correct for the equipment, can be disposed of safely, and will achieve the desired outcomes.
