Scope

Description

Watford Borough Council (‘the Council) intends to extend the contract with NSL Ltd for the provision of parking enforcement services in Watford. The contract is for the provision of enforcement of all on and off-street parking restrictions, together with the relevant supporting management, maintenance, enforcement and processing staff, including vehicle fleet, equipment, printing/posting provisions and optional ad hoc services such vehicle pound and removal.

The maximum potential total of the extension sum is £3.258M million and anticipate that it would commence on 1 April 2027 when the current contracts ends (on 31 March 2027) for a period of 3 years with a break clause at year 2 on 12 months’ notice.

The existing contract falls under the 2015 Public Contract Regulations. Therefore any decision on extension needs to take account of those set out in Regulation 72 of the PCR’s.

The proposed extension would fall within the provisions of Regulation 72(c)where all of the following conditions are fulfilled:—

(i)the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen;

(ii)the modification does not alter the overall nature of the contract;

(iii)any increase in price does not exceed 50% of the value of the original contract or framework agreement.

This (a) notifies the market of the intention to award a contract to a certain provider without competition, and (b) provides for a 10 day (15 day in some circumstances) 'standstill' period to allow challenge to that decision.

Watford Borough Councils Parking Enforcement Contract with NSL expires in March 2027. NSL have provided Parking Enforcement Services since 2018.

Local Government Reorganisation means that it would not be appropriate to go out to tender to reprocure this service, for a number of reasons:

•Revised geographic and service delivery boundaries and the scale of the subsequent service delivery model required, which needs to be determined by successor authorities.

•In house and outsourced services are delivered across Hertfordshire and a need to align decisions on service delivery models and contract expiry.

•It will require significant officer resource to re procure and broadly has a 2- 3years procurement timeline requiring external resource.

•Harmonisation of service standards across former district and borough footprints to new Unitary Authority footprints will take time and needs to be determined by successor authorities

•Consolidation of on and off street parking provision

•Different contract end dates across Hertfordshire

•Consolidation and harmonisation of Traffic Regulation Orders across new unitary authority footprints and associated enforcement regimes

•Consolidation of back office services and appeals management.

•Consolidation of Infrastructure management

•It would impractical and not cost effective to reprocure at this time
