Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Phase 0 works as detailed in the contract identified additional 3rd party activities required to bring the facility to the status outlined in the tender documents.

This requirement could not have been identified without the contracted enabling works and does not represent a change specification for the contractor.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee.

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Tender documents were produced in collaboration with site owners and operators and represented the condition as owner operator reasonably understood to be the case as part of tender validation.

Enabling works identified shortfall that the could not have been identified earlier in the process and will require additional pass through costs to identified 3rd parties to resolve.
