Residents are able to maintain their independence by having their own home whilst having the benefits of having staff on hand 24 hours a day, 7 days a week. The care staff can be used to provide either planned support or ad-hoc support in response to emergencies or Tunstall calls (Tunstall is a call system that is placed in each flat and allows residents to call for assistance at any time of the day)\nThe care and support services in these schemes are currently delivered by Radis Community Care (GP Homecare Ltd company).\nThe aim of the care service is to promote and maximise independence for the residents. There are 4 extra care schemes across Portsmouth as follows - \n-\tBrunel Court - located in Nuffield Place, 55 apartments.\n-\tMilton Village - located in Moorings Way, incorporates 65 apartments built as a complex. This is over 3 separate buildings - Crane Court (12 apartments) Osprey Court (16 apartments) and Brent Court (37 apartments).\n-\tCaroline Square - located in Portsea, 43 apartments. \n-\tMaritime House - located in Northern Parade, 80 apartments. \nThe landlord of all 4 schemes is Housing21 and this does not form part of this PME exercise or the subsequent tender. \nThe personal care hours into the extra care schemes fluctuates on a weekly basis depending on the individual's needs, there is also a fixed element linked to every scheme which is used for the ad-hoc support such as responding to Tunstall calls, extra support for residents or assisting with mealtimes in communal areas. \nCONTRACT DURATION & TERMS\nThe Council envisages entering two separate 4-year contracts, extendable by a further 4-years in increments to be agreed at the time by both parties. The full scope of the services will formally commence on the 1st December 2025.\nThe Council is currently reviewing options for contract terms and conditions and will be seeking input from the market via this preliminary market engagement process.\nTUPE\nThis is a re-procurement of an existing outsourced service and therefore will be subject to TUPE. As such there will be a TUPE transfer of the incumbent's 'in scope employees' as part of this contract. It will be the providers' responsibility to manage any TUPE / Pension implications.\nENVISAGED PROCUREMENT PROCESS &PROGRAMME\nThe Council are considering running the procurement process using an Open Procedure under the Procurement Act 2023, though the Council could use a single stage Competitive Flexible Procedure to incorporate additional flexibilities in respect of the approach to evaluating returns i.e. the inclusion of interviews, presentations etc. \nOpen Procedure\nThe Council will issue a Tender Notice under the Procurement Act 2023 outlining the key details and requirements, including the overview of the procurement process & associated programme, value of the opportunity, scope of the contracts, lotting options & associated contractual terms, minimum levels of technical experience & accreditations and evaluation & award criteria.\nThe Open Procedure is a single-stage competitive process where all interested suppliers may submit a tender, and there is no pre-qualification stage. \nAs part of this process, suppliers will be required to meet Conditions of Participation before their tender submissions are assessed. These conditions will relate to the supplier's legal and financial standing and technical ability to deliver the contract, which is likely to include the successful delivery of current and/or previous contracts of a similar value and scope as the Council's.\nIn addition, all suppliers and proposed subcontractors involved with the service delivery will be subject to assessment against the mandatory and discretionary exclusion grounds.\nMandatory exclusion grounds include, but are not limited to, convictions for offences such as fraud, bribery, terrorism, and cartel activity. Extra care housing schemes in the city are a specialist sheltered housing provision designed to offer a safe, private and secure environment. Residents are able to maintain their independence by having their own home whilst having the benefits of having staff on hand 24 hours a day, 7 days a week. The care staff deliver planned care, ad-hoc care support in response to emergencies or Tunstall calls (Tunstall is a call system that is placed in each flat and allows residents to call for assistance at any time of the day), and support with delivering and attending activities.\nThe current cost for delivering services across these four Extra Care schemes is approximately £3.5 million per annum. However, this value can fluctuate on an annual basis dependent on existing occupancy levels and the support needs of the residents. The care and support services in these schemes are currently delivered by Radis Community Care (GP Homecare Ltd company).\nThe size of the block hours allocated to each scheme can also affect the value. Additionally, each contract will be subject to an increase in rates, which will be reviewed on an annually basis and has typically been based on the Retail Price Index. \nThe Council are seeking two providers for two separate Lots - \nLot 1 - Brunel Court, Caroline Square and Milton Village - £2.2M per annum (1417 hours of planned care in total, plus block hours)\nLot 2 - Maritime House £1.4M per annum (960 hours of planned care, plus block hours)\nThe contract values included on each lot above are based on current levels of demand and the previous year's spend. Key areas of concern identified in CQC inspections and noted in contract monitoring relate to: \n•\tStaffing - some behaviours not person centred and not in line with dignity/ organisational values \n•\tMedication systems concerns about processes, governance and staff competence \n•\tEvidencing supporting service users safely: recognising risks and assessing appropriately- e.g. falls, nutritional needs, lack of knowledge and appropriate application of MCA. \n•\tLack of evidence of service users being involved in their care/ being given opportunity to provide feedback \n•\tLack of evidence of learning and embedding learning from incidents \n•\tLeadership - governance systems not adequate, failing to pick up issues identified, including training, medication errors, deficits in care planning/ risk assessment. \n'Turnaround' Period and Funding\nThe contract allows for a nine month 'turnaround' period to address the existing issues in Extra Care in Portsmouth. The Council will pay a maximum of £75,000 per Lot to support turnaround of the Services, which are expected to be completed within nine months of the start of the contract. \nAn independent third-party provider will be commissioned by the Council to conduct a 2-day mock CQC inspection at each individual scheme within two weeks of the start of the Contract. The same provider will then be asked to complete an identical audit at the end of the nine-month turnaround period. \nIf the mock CQC inspection at the end of the nine-month period shows no improvement, the Service Provider will be given an additional three-month period to make improvements, and a further mock CQC inspection will be commissioned at the end of this period.\nIf at the end of the three-month turnaround extension period no improvement has been made, the Service Provider shall be considered to have defaulted under the terms of the Contract, as described in the Terms and Conditions.\nPayment of turnaround monies will only be made where the audit shows that the mock CQC inspection outcome is at least one standard higher than at the start of the turnaround period. Following this, the Council also intends to publish a Contract Details Notice.\nDESCRIPTION OF CONTRACT\nThe Council is responsible for four extra care schemes in the city. Extra care housing schemes in the city are a specialist sheltered housing provision designed to offer a safe, private and secure environment. Residents are able to maintain their independence by having their own home whilst having the benefits of having staff on hand 24 hours a day, 7 days a week. \nThe care staff deliver planned care, ad-hoc care support in response to emergencies or Tunstall calls (Tunstall is a call system that is placed in each flat and allows residents to call for assistance at any time of the day), and support with delivering and attending activities.\nThe current cost for delivering services across these four Extra Care schemes is approximately £3.5 million per annum. However, this value can fluctuate on an annual basis dependent on existing occupancy levels and the support needs of the residents. \nThe size of the block hours allocated to each scheme can also affect the value. Additionally, each contract will be subject to an increase in rates, which will be reviewed on an annually basis and has typically been based on the Retail Price Index.\nThe Council is awarding two contracts to two providers for two separate Lots -\nLot 1 - Brunel Court, Caroline Square and Milton Village - £2.2M per annum (1417 hours of planned care in total, plus block hours)\nLot 2 - Maritime House £1.4M per annum (960 hours of planned care, plus block hours)\nThe contract values included on each lot above are based on current levels of demand and the previous year's spend. However, the value of the opportunity can fluctuate dependent on the needs of the individuals, occupancy and the size of the block.\nThe contract term for both lots will be for 4 years with options to extend in increments to be agreed up to a maximum of 6 years. Both contracts will commence on 1st December 2025. \nThe total value of the opportunity will be in the region of £45.5M, when including all extension options, assuming each Extra Care facility remains in maximum occupation, the likely support needs of the residents and including any potential inflationary uplifts. \nThe Council estimate the total spend over the maximum extension period for each lot to be -\n• Lot 1 - £27.9M\n• Lot 2 - £17.6M\nThe contract allows for a nine month 'turnaround' period to address the existing issues in Extra Care in Portsmouth. The Council will pay a maximum of £75,000 per Lot to support turnaround of the Services, which are expected to be completed within nine months of the start of the contract.\nA block number of hours is allocated per scheme to cover additional staffing requirements for Background Care and Support. The block will be set at 630 hours for Lot 1 (which includes 3 Schemes the hours may be used flexibly across the Schemes as required to meet the needs of each Scheme) and 294 hours for lot 2 for the duration of the turnaround period for both lots. \nAfter this time and with supporting evidence the Service\nProvider in discussion with the Service Purchaser is expected to review and right-size the block hours to a level that can support the safe delivery of care within a scheme. Evidence may include but will not be limited to:\n• The volume of ad hoc support provided\n• The volume of responses to emergency calls\n• The provision of activities\nAs already identified above, the Council require the current service provisions to improve across all the sites, under both the lotting options. The Council are investing additional turnaround funding to improve the service provisions within the first nine to twelve months of the mobilisation of the new contract.\nIf a provider under either lot cannot satisfy the requirements to demonstrate the service has improved within this timescale, and the subsequent contract is to be terminated, the Council reserve the right to use any of the following options at their discretion to award a contract to an alternative provider -\n• If the lot 1 provider fails to meet the agreed performance requirements, the Council reserves the right to award the contract to the lot 2 provider.\n• If the lot 2 provider fails to meet the agreed performance requirements, the Council reserves the right to award the contract to the lot 1 provider.\n• If a provider under lot 1 and/or lot 2 fails to meet the required performance standards,\nthe Council reserves the right to engage the next highest-ranked provider from the original tender evaluation for the relevant lot. \nShould the next ranked provider decline the opportunity, the Council will proceed to engage with the subsequent ranked provider(s) within that lot, in order of ranking, until a suitable provider is secured.\nIn order for the Council to consider any direct award options, providers must continue to meet all minimum requirements as originally set out in the conditions of participation.\nThis includes maintaining compliance with applicable legislation, statutory guidance, and regulatory standards in force at the time of award. the services summarised within the 'Scope' section of this PME Notice.\nThe procurement process will commence in June 2025 with award targeted for August 2025 to allow for mobilisation and commencement of services on 1st December 2025. \nThis engagement aims to assess the markets interest in the contract, explore commercial models, and understand the markets capability and capacity. By engaging with suppliers, the Council seeks to ensure that any potential procurement strategy is well-informed, commercially viable, and aligned with industry best practices.\nAdditionally, this process will help identify potential risks, opportunities, and ensuring the successful and efficient delivery of any potential contract.\nThe Preliminary Market Engagement exercise shall comprise of a Microsoft Teams meeting outlining the current service delivery, the Councils expectations for the future delivery of the service, procurement strategy and submission and subsequent analysis of engagement questionnaires.\nTo assist suppliers with understanding the purpose of the questionnaire and effectively answer the questions, the Council will provide an overview of the questionnaire at the Microsoft Teams session.\nFollowing the Microsoft Teams meeting the Council will issue the market engagement questionnaire via In-tend.\nThe Microsoft Teams session will take place at the 21st May 2025 at 13:30.\nThe questionnaire will be published following this session and should be completed and returned by 30th May 2025 23:59.\nPME PRINCIPLES\nThe Council wishes to engage with suppliers who have experience in undertaking care and support in Extra Care Housing. In summary, the preliminary market engagement objectives are to:\n• Share Information:\no Current requirements, demand, and cost models,\no Envisaged contracting strategy, including duration and extension options,\no Envisaged timeline,\no Envisaged commercial and management model.\n• Review and Understand:\no Market capacity and capability to deliver the future requirements,\no Market interest,\no Ability to manage likely TUPE transfer considerations, \no Costing options, pressures, and budget.\n• Inform the development of the procurement strategy:\no The contract delivery strategy,\no The scope of the contract,\no Commercial model,\no Procurement strategy, including programme, conditions of participation, tender award criteria,\no Budget.\nThe key areas the Council are seeking feedback from the market through gathering information through the engagement questionnaire are -\n• Market Capacity\no Geographic Coverage: where suppliers currently operate in relation to the Council's location.\n• Market Capability\no Envisaged Scope: understand and review the scope\n• Market Commercial Perspectives\no Pricing Models and Budget: review the market norms on how such services are costed over term of contract, sufficiency of budget.\no Contractual and Legal Considerations: review of market norms in respect of the suggested contractual model, term, and other options.\nREQUESTS TO PARTICPATE IN PME INSTRUCTIONS\nSuppliers interested in taking part in Microsoft Teams session or Questionnaire Guidance meeting on Microsoft Teams are required to complete the following forms which are accessible via In-tend:\n• the Participation Request form\n• Conflicts of Interest Declaration\nSuppliers are required to return the forms by no later than 20th May 2025 at 12:00 and submit via In-tend correspondence function.\nMICROSOFT TEAMS SESSION\nThe Council shall be holding an online Microsoft Teams session on the 21st May at 13:30. The draft agenda for this event is as follows:\n•\tWelcome and introductions,\n•\tPCC Presentation\n•\tQuestions and answers\nSuppliers are required to complete and return the request for participation form which can be downloaded from the Council's intend portal and submit via In-tend correspondence function.\nMARKET ENGAGEMENT QUESTIONNAIRE GUIDANCE\nA word version of the questionnaire will be provided after the completion of this meeting through In-tend. Suppliers are encouraged but not obliged to complete the questionnaire.\nCompleting the online questionnaire will help the Council to understand the delivery options of the contract provision and subsequently, the structure of the procurement to ensure it can be carried out by the market and optimises the participation of suppliers, including SMEs.\nThe Council are requesting the questionnaire is completed by 30th May 2025 by 23:59, any responses after this deadline may not be considered in the PME report. Completed questionnaires are to be submit via In-tend through making a return against the In-tend PME stage.\nPME ANALYSIS & REPORTING\nThe Council reserves the right to contact suppliers following submission of questionnaires in order to gain clarification and understanding of the responses. This will be via In-tend correspondence.\nAny suppliers who submit a completed questionnaire will be sent a copy of the draft PME Feedback Report, which will accompany the procurement process documentation. This report shall provide a summary of the overall trends in the response received against the areas of consideration.\nThe Council are aiming to have collated the PME feedback by 4th June 2025 to issue the draft report via Intend correspondence for suppliers to review.\nPME CLARIFCIATION PROTOCOLS\nAny queries, questions or clarifications regarding this preliminary market engagement exercise must be made in writing using the project correspondence facility on the In-tend system.\nAny questions and answers from either event will be recorded via a separate clarification log and will be published to Intend for all suppliers to access, unless deemed commercially sensitive.
