seven.2) Information about modifications

seven.2.1) Description of the modifications

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

The original contract value published included fixed costs, however in error excluded variable operational charges e.g. Card Processing, PaybyPhone Transaction Fees, DVLA charges etc. This resulted in an understated total being reflected in the original contract award notice placed (35%). The revised value now reflects all known charges and realigns to reflect increases in NI and postal charges plus the execution of a pilot ANPR scheme under the terms of the original agreement (63,832).

The introduction of ANPR technology across station car parks in Wales was included as an option. This notice confirms the execution of this call off and the respective value.

Due to the unforeseen delays in securing the necessary Network Rail Landlord consents, as required for the contractor to access the land and deliver the necessary works, the Authority intends to modify the contract terms for up to a further 24 months, to allow the supplier sufficient time to fully deliver their contract commitment in line with the original scope.

seven.2.2) Reasons for modification

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee.

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

88. (1) Contracts and framework agreements may be modified without a new procurement

procedure in accordance with these Regulations in any of the following cases—

a where the modifications, irrespective of their monetary value, have been provided for in

the initial procurement documents in clear, precise and unequivocal review clauses,

which may include price revision clauses, or options, provided that such clauses—

i state the scope and nature of possible modifications or options as well as the

conditions under which they may be used; and

ii do not provide for modifications or options that would alter the overall nature of the

contract or the framework agreement.

Additionally -

c where both of the following conditions are fulfilled

i the need for modification has been brought about by circumstances which a diligent

utility could not have foreseen;

ii the modification does not alter the overall nature of the contract.
