Scope
Description
The highbay stack system ("HBS") will be a BoxBay empty superstack for storage of containers, which is positioned between the existing Berths 3 and 4 that are already in operation at London Gateway Port ("LGP"). The implementation of this HBS is required for LGP's efficient management of empty containers in circulation at LGP. This will enable a more efficient and effective transition of goods and services provided by LGP, delivering benefits to the UK trade sectors and the wider economy.
The scope of the requirement includes:
a) The full design, engineering and manufacturing works for the major bespoke equipment for the HBS;
b) The supply of a bespoke Storage and Retrieval Machine (SRM) necessary for the automation functions;
c) The installation and erection management and technical assistance, providing technical direction at site for the integration of the major equipment with works provided by others to ensure the HBS operates as intended; and
d) The Commissioning services to prepare the HBS for operations

BoxBay FZCO is a unique provider of HBS with multi-faceted capabilities that can be integrated with existing LGP operations. The company has delivered a similar HBS system previously and is experienced in delivering such works.
The BoxBay HBS design is a proprietary technical system that is founded upon patented and trademarked intellectual property, which is exclusively marketed by and licensed to BoxBay FZCO.
BoxBay HBS is currently the only system in the global market that can deliver all of the following capabilities in the constrained and limited site areas in LGP between two existing operational Berths (3&4):
• High - volume and high-density capability: BoxBay HBS is a system that is capable of operating at the performance level, necessary to meet LGP's operational output requirements, in the restricted space available at Site.
• Integration with the Automated Stacking Cranes ("ASC"): BoxBay HBS integrates with ASC, ensuring high performance rate of movements necessary to operate within the port.
• Integration with the LGP Terminal Operating System ("TOS"): BoxBay HBS integrates seamlessly with the LGP TOS, ensuring that the required operational performance levels at the port are maintained.
• Dual-function capability: BoxBay HBS is a unique system which offers both high density storage and high-performance movement capability working separately and collectively between waterfront port operations and landside storage areas. BoxBay HBS is the only system that can operate in this manner sufficiently within an ASC operated terminal, most notably at LGP in respect of the site constraints and operational requirements.
BoxBay FZCO is the only company which is licensed, experienced and capable to develop and deliver this bespoke system meeting LGP's requirements. Due to the intellectual property associated with the system design, there are certain parts of the technology (equipment and components) that are integrated into the HBS that can only be provided by BoxBay as exclusive licensee of the proprietary system and design.
For the avoidance of doubt, this contract reflects only the award of the supply and installation of the key equipment and components (arising from the licensed intellectual property) as part of the overall HBS structure. The associated civil and structural engineering works required to complete the HBS, which these key equipment and components integrate with, will be tendered separately via open competition to ensure ongoing market engagement.
A direct award is justified under section 41(6) in conjunction with paragraphs 5 and 6 of Schedule 5 of the Procurement Act 2023:
-the works can only be delivered by BoxBay FZCO due to that supplier having intellectual property rights, and there are no reasonable alternatives to those works;
- due to an absence of competition for technical reasons, only BoxBay FZCO can supply the works required, and there are no reasonable alternatives to those works
